Still Dark Dungeons....

'Training through D&D"...it's no longer Dark Dungeon....so much for copyright. The DD vice D&D was sufficient to confuse them at the first, but surely TSR's (Now Wizkids, or whoever has the most money these days) lawyers wouldn't read THIS far....

In regards to possible copyright infringement, Title 17 of the United States Code, Chapter 1, Section 107: "Limitations on exclusive rights: Fair use", says :

"Notwithstanding the provisions of sections 106 and 106A, the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright." (emphasis mine) The four criterias to determine whenever such a use is permissible or not are : the purpose and character of the use, the nature of the copyrighted work, the amount and substantiality of the portion used in relation to the copyrighted work as a whole, and the effect of the use upon the potential market for or value of the copyrighted work. Right off the bat, i have to wonder what the potential market value of something that is designed to be handed around freely is? As to purpose and character, i am not changing any of the material to read anything different from what the author intended, or to replace any characters with caricatures. There is no advertisement on this site, nor have i scanned in anything that is not available freely from the Chick Publications site.
